Will They take back child support payments out of life insurance if the insured dies? My father owes my mother years of back child support for his three biological children. I think over $10,000. Will they take out what he owes in child support if I, his biological daughter age 28, has a life insurance policy on him?

Your father’s estate will be responsible to pay his personal debts. However, a life insurance policy which you own and are the beneficiary of will not pass through his estate. The proceeds are paid directly to you. Any other property which he has in his name alone at the time of his death would likely be subject to your mother’s claim and to that of any other creditors.
